The fight to protect our City Charter and the citizens of Warren continues, I am profoundly disappointed by the visiting long-retired district court judge’s opinion. I believe he came to the wrong decision by leaving the case open. We requested a declaratory judgement last week so that we could move this process to the Michigan Court of Appeals. I believe the judge misread our City Charter, which demands cooperation between the mayor and council on development of the budget instead of the unilateral approach of the City Council. In addition, the judge appears to have relied upon an unpublished opinion instead of a more solid published opinion, which supports our position. We hoped to appeal this decision to the Court of Appeals, and if necessary the Michigan Supreme Court, to make certain the Warren City Charter is properly enforced and our system of checks and balances is protected. No one branch of government can give a unilateral decision without a compromise between the two branches. In a democracy, no branch of government is supreme. In addition, the Warren City Charter refers to the Mayor’s budget never once does it say the City Council budget. Therefore, “justice delayed is justice denied” and that is why I am hopeful the judge will reconsider leaving it open and close the case and allow an immediate appeal to the Court of Appeals.
